After advertisement in the Trade Marks Journal and the 4-month opposition period, the trademark is registered.
The end-to-end process takes between 18 months and 3 years depending on whether objections are raised and whether the mark is opposed. A TM application number is issued immediately on filing and provides prima facie protection from the date of application.
A trademark objection is raised by the Registrar’s examiner during examination if the mark fails to meet registrability requirements. A trademark opposition is filed by a third party — usually a competitor or an existing brand owner — after the mark is advertised in the Trade Marks Journal. Both require a written response within the prescribed period.
Yes. Trademarks are class-specific under the Nice Classification system (45 classes). If your brand covers multiple categories, you need separate filings per class. We advise on cost-effective multi-class strategies.
™ (TM) can be used as soon as you file your trademark application. ® (Registered) can only be used after your trademark is officially registered by the Trade Marks Registry. Using ® before registration is a criminal offence under the Trade Marks Act.
It depends on the class of goods/services, geographical presence, and evidence of prior use. A trademark search will reveal conflicts. Identical marks in the same class cannot coexist; similar marks in unrelated classes may be permissible. We assess risk before filing.
