Frequently Asked Questions — DSC & Legal Compliance Services

Everything you need to know about Digital Signature Certificates, business registration, trademark, and working with FinLegit — answered clearly, without jargon.

Digital Signature Certificate (DSC) — General

What is a Digital Signature Certificate (DSC)?

A Digital Signature Certificate is the legally recognised digital equivalent of a handwritten signature or physical stamp. Issued under the IT Act, 2000 by licensed Certifying Authorities (CAs), a DSC verifies your identity on government portals and allows you to sign documents electronically — with full legal validity.

Is a DSC the same as an Aadhaar e-sign?

No. An Aadhaar e-sign is a one-time OTP-based signature for simple forms. A DSC is a full cryptographic certificate — stored on a USB token or software file — valid for 1–2 years and usable repeatedly across portals like MCA21, GST, DGFT, and EPFO. Most mandatory compliance filings require a DSC, not just an e-sign.

What is a Class 3 DSC? Is Class 2 still available?

Class 2 DSC was discontinued by the government in January 2021. All DSCs issued today are Class 3 — the highest security level, requiring Aadhaar-based or in-person identity verification. Class 3 is accepted on all government portals in India.

How long is a DSC valid?

Typically 1 or 2 years from the date of issue. A 2-year DSC offers better value. We send renewal reminders before expiry so you’re never caught off guard.

What is the difference between a Signing DSC and a Signing + Encryption DSC?

A Signing DSC lets you sign documents and verify your identity — used for MCA, income tax, GST, EPFO, and most portals. A Signing + Encryption DSC does both: signs AND encrypts sensitive data during transmission — required for e-tendering portals (GeM, CPPP) and DGFT applications. Not sure which you need? Call us.

Can one DSC be used on multiple government portals?

Yes. A Class 3 DSC issued under your PAN is a universal digital identity accepted on MCA21, GST portal, DGFT, EPFO, IP India, income tax, and e-tendering portals. You register it separately on each portal, but use the same physical token or software file.

Paperless & Aadhaar eKYC DSC

What is a paperless DSC?

A paperless DSC uses Aadhaar eKYC — your fingerprint or OTP — to verify identity without physical document submission. It’s 100% online and typically done in 15–60 minutes. The DSC issued is legally identical to one issued via traditional methods.

Do I need a biometric device for Aadhaar eKYC?

No. If a biometric device isn’t available, you can use Aadhaar OTP — a one-time password sent to your Aadhaar-linked mobile number. Our team advises you on the best method for your situation.

Is a paperless DSC legally valid?

Completely. Aadhaar eKYC is an approved verification method under the IT Act, 2000. A paperless DSC is accepted across all government portals and carries the same legal weight as one issued via physical document verification.

Business Registration

What is the fastest business structure to register in India?

A Sole Proprietorship is the simplest — registered via MSME or GST, with no mandatory ROC compliance. If you need limited liability, a Private Limited Company or OPC is better — typically incorporating in 7–15 working days through the MCA SPICe+ form.

Do directors need a DSC to register a Private Limited Company?

Yes. All proposed directors must have a Class 3 DSC before filing the SPICe+ incorporation form on the MCA portal. FinLegit handles both the DSC and company registration together — you save time and avoid coordinating between multiple providers.

Can NRIs or foreign nationals register a company in India?

Yes. Foreign nationals and NRIs can be directors or shareholders in Indian companies. They need a Foreign National DSC (passport-based, no India visit required), a DIN, and in some cases notarised or apostilled documents. FinLegit specialises in guiding overseas clients through this process.

Trademark

Why do I need a DSC to file a trademark application?

The IP India portal requires a Class 3 DSC to file trademark applications online. Online filing is faster, cheaper (discounted government fee), and lets you track and respond to objections directly through the portal. Without a DSC, you must file physically — which is slower and more expensive.

How long does trademark registration take?

You receive an application number immediately after filing. Full registration typically takes 18–36 months, depending on examination, objections, and oppositions. FinLegit handles the complete process from application to final certificate.
